Hi Jane,

 

When this was happening quite frequently at one of the school I relieved
at, I actually rang the company and wrote a confirmation letter that we
would not accept any On Approval books, CD's, etc., unless they were
accompanied by an official school order.  Therefore, if the goods were
not returned on time, or got lost, it came out of the specific area
budget.  This seemed to work really well and made the teachers a bit
more responsible.

Does anyone know the legal standing on a school accepting goods "On
Approval".  There are three scenarios on which I would like
clarification.

1.                    Goods are sent out "On Approval" to a school and
then distributed to the appropriate faculty for perusal - no formal
request from the school.

2.                   Goods are sent out "On Approval" after a staff
member has been contacted by phone by the company and asked if they
would like to see the goods first.  The initial contact was from the
company.  

3.                   Goods are sent out "On Approval" from the staff
member's request, having seen the goods at a conference, show etc.

 

We are having a disagreement with a company from Scenario 2 and I would
like to know where we stand as the return time limit is up and they are
wanting payment.  Unfortunately it is always the office that cops the
irate phone calls not the teaching staff.
