[Year 12 SofDev] Ethical problems

Hi all,
Wanted to ask if you thought that not bothering to keep your system up to date (eg virus definitions, windows update etc...) is an ethical problem or a legal one if the system is used to keep private data of clients?

My feel is legal but, thought I would throw it out there.
