Thank you gents, I guess the same logic would apply to an attachment. If the email itself is possibly admissible, but not binding, then so should be the case of the attachment.

Damien,
There have been a number of cases were email's have been called in as official correspondence, my guess in a limited legal capacity is that it may not be formally documented as law but there would be precedents that can be sited to allow email to be granted the same status as a signed letter or memo.
I think it is case that would be great for a brave lawyer.
I also agree with Roland about the birds nest article.

Another question to add to this, Is the attachment to an email legally binding?? I.e. PDF file.

Hi folks,
            I've been asked to have a look at a friend's email policy - the preamble into it got me a little flustered and I'm just trying to work out the legitimacy of the statement "Email carries the same legal status as a signed letter or memo." I've had a look in the telecommunications act and the postal act but cannot find it. I'm wondering if anyone out there knows if this statement is pure smoke or not.
