Dear colleagues

 

I will clarify the concerns raised in several messages posted to this
list regarding VCAA's copyright policy. In essence, the copying or
downloading of any material from the VCAA website can be for personal
use only. Reproduction and transmission of these files is not permitted,
which is in accordance with the Copyright Act. As you will see from the
following extract from the VCAA's copyright policy, written permission
must be sought to use VCAA material on a school website.

 

Copying or downloading files from this website: Users can copy or
download files from this website for personal use only. Reproduction and
transmission of these files is not permitted. Victorian schools only may
make copies of files for use by teachers or students. Written permission
must be sought from the Victorian Curriculum and Assessment Authority
before placing any VCAA material on your Internet site. Victorian
schools can only make copies of files for use by teachers or students. 

In the case being discussed, no permission has been sought to use VCAA
material. Schools are able to include files on their intranet, but not
on their school website, which is then available for public use. 

 

Regarding examinations, permission must be sought before reproducing
examination papers or extracts. Part of this stems from the fact that
there is often third party copyright material in exam papers, so
permission was granted to VCAA only to use this material. For this
reason, schools can apply for permission to place these exams on their
intranet. Again, in this case being discussed no permission had been
sought to reproduce and transmit this examination on a website. Here is
the extract from the VCAA website regarding examinations copyright. 

Written permission must be sought from the Victorian Curriculum and
Assessment Authority before reproducing VCE examination papers or
extracts. 

No permission will be given for VCE examination papers or extracts to be
reproduced on Internet sites. Permission may be sought for intranet
sites and a link to the VCAA website (www.vcaa.vic.edu.au). 

VCE Examination Papers may be reproduced provided that: 

*	the material is not reproduced in the exam paper format 
*	that there is value added material included in the publication 
*	the end user clears all third party copyright material in exam
papers 
*	a fee will apply for all commercial uses. 

In the case being discussed, the 2006 IPM assessment report was being
quoted. This report is available on the VCAA website at:

provisions of the Copyright Act, as it forms part of the IT applications
