Just to be 100% clear for everyone on this:

*	If a teacher resigns or retires on the first day of a term (i.e.
they don't attend for duty) they are still entitled to be paid for the
holidays, as long as they were being paid at the end of the previous
term. This has been the case for years (28 that I can personally vouch
for!).  The same rules apply to a fixed term teacher that wants to cease
prior to their 'contracted' end date.  Their employment ceasing at the
end of their 'contract' is not a resignation.
*	There is a very real difference between resignation and
retirement for employees who are in the defined benefit super schemes
(i.e. Revised, New or SERB).  If ceasing prior to their 55th birthday it
is a resignation.  If ceasing on or after their 55th birthday, it is a
retirement.  It is VITAL that the correct code be used on HRMS as the
GSO will calculate/pay benefits based on what is recorded on HRMS.
*	If not in one of the defined benefit schemes, whether the
termination is recorded as a retirement or resignation is not important.

Basically, if teachers are ongoing they can resign after the holidays.
Obviously if they are on a contract which concludes at the end of this
year they can't get paid for the holidays then resign/retire after that.

Hi Jan,

We have the same thing happening, and they can set the day, as long as
they're eligible for holiday pay.

Both of ours are resigning on 29th January, so they don't have to start
back in 2007.

You're allowed to claim back any monies you pay them from 1st January,
if you have to pay replacement teachers from the beginning of the year.

I have two teachers retiring/resigning  at the end of this year.  They
want to know if they can retire / resign on the 30th January 2007.

What are the rules? (One teacher is 62 the other 59)
