Hi
We have the same situation and we could find no reason on the HR A-Z why
she could not get a certificate from her doctor stating she was fit to
work until 30 January. I rang HR and we had to go ahead , so she gets
paid rec leave and then takes the 14 weeks from 30 Jan.

I have attached a copy of the guidelines for Maternity Leave, if this
staff member falls into the six week period during the school holidays
then I believe that, that is when her leave begins from, they can't have
their cake and eat it too. I think you should get clarification from
Schools HR to make sure but really if her 6 weeks prior to the due date
starts in the holidays then they have to accept that this is the date
their leave begins from. Remember that you can do a salary mischarge
from 01/01/2007 until the day she goes on leave if you are replacing her
with another staff member that you have to pay from 01/01/2007 so that
you are not paying for 2 people for the same postion. This will be a
good one for you to tell us all when you get the answer from HR.
Required period of absence
A member of the teaching service who is pregnant must absent herself
from duty for the period commencing six weeks prior to the expected date
of the child's birth until six weeks after the actual date of
confinement.
A member of the teaching service may attend for duty during any part of
the required absence period if the principal is satisfied that:
* she will be fit for duty for the relevant period (proof of
which is to be by medical certificate supplied by the staff member), and
* the staff member's attendance for duty will not adversely
affect the school's operations; and
* the return to duty sought by the staff member is at a time
staff ordinarily attend for duty at that school.
Where a staff member is permitted to attend for duty during the part of
the required absence period before the birth of the child, the twelve
weeks' maternity leave commences from the first day of absence from
duty.
General provisions
A member of the teaching service who has at least twenty-six weeks'
qualifying service within the fifty-two weeks immediately preceding the
commencement of the maternity leave is eligible for fourteen weeks
maternity leave with pay in respect of the birth of a child on or after
the 4 August 2004.

Hi all,
I have a full time staff member who is pregnant and her due date is 26th
Feb. 6 weeks prior to that is 13th Jan however, she wants to know if she
gets a doctor's certificate stating she is fit to work and comes to work
on Jan 30th (pupil free day) could she start family leave from 31st Jan,
as she would prefer not to have to take family leave during the xmas
holidays. I know if it's during a term it's ok but am unsure whether the
vacation period alters that.
I've explained to her that she gets 14 weeks paid leave, but she wants
to know if she can be paid at half pay rate over a longer period. Never
been asked that before, so haven't got the foggiest!
I'm hoping that someone will have the answers.
